Hello,
I am in a pretty scary scenario...
My I-140 got denied based on inability to pay. My firm did send out the appeal to fight out the case. The appeal was sent 15 days back with the time limit stated in the denial letter. But today, I received the I-485 denial for both me (primary applicant) & my spouse (dependent).
I have H-1 as a back up but my spouse does not have H-4 status.
My Questions & concerned:
1) How long does it take INS to accept the appeal as I haven't seen any update on the same since the package has been delivered (15 days)?
2) What is next possible step for my spouse & how long can he stay in this country without applying for H-4?
3) If the appeal is accepted & the case gets into processing, will I-485 get back on track for processing & can my spouse start working on EAD?
Would appreciate any sought of guidance possible from the expert lawyers & the individuals with the similar experience & knowledge.
Time is very crucial & so immediate reply will be highly appreciated...
Thanx in Advance

Hello all. This is a basic question: Are all 501(c) employers exempt from the H1 cap? I have heard and read so much about some non-profits being exempt from the H1 cap, but no one could tell me with certainty which ones.
Thanks

Hello,
Please let me know if anybody is travelling from BLR(Bangalore) to BOS (Boston) by British Airways on Mar 1 2011.
Because my mother-in-law is visiting US and she is travelling alone. If some travel companion is there it will be helpful as she does't speak english.
Thanks in advance.

Background - My wife's immigration timeline
H1-B 01/2000 to 8/2001
Moved to O-3 as dependent due to old 6 yr H1-B rule.
O-3 9/2001 to 5/2006
Stepped out of the US in May 2006
The intention was to get a full 6 yr H1-B (decoupling didn't exist)
Questions while applying for H1-B to reclaim reminder of 6 yrs in H1-B
1) Can she apply for H1-B while she is in India?
2) Can she enter the country as my dependant and work on approved H1-B?

gcformeornot is correct. You cannot "transfer" an I-140 approval, but you can keep and use the PD for any subsequent I-140. Once a new LC is approved, a copy of the I-140 approval notice with the 10/2007 PD should be included in the new I-140 submission along with a request to use the old PD on the new I-140 approval notice.

Hi,
My H1B is getting expire in Oct,2008.I am planning to extend my H1B. My wife came to US on H4 and converted to H1B (expiring on Sep-2009).
I applied I-485 Pending. Me and My wife got EAD and AP expiring Sep-25-2008. (Applied Renewal). Now My wife is working on EAD.
In my H1B ext. application, They are asking about my wife I-94 status. Which one should I give?. H4 (I-94) or Convert H1B (I-94) or EAD information.
Please advise me.

hi,
My company filed for H1B Extension as it is expiring in november 2009. How much time will it take to get the H1B extension approved ? Once i get H1B extension(probably for 1 year or 3 years), then should i go for H1B stamping, if so, i have to go to India for H1B Stamping. Let me know...
Thanks in advance....:)

There used to be a Remington Razor commercial with the late Victor Kiam where the entrepreneur said "I liked the razor so much, I bought the company." That kind of reminds me of the story of my friend and colleague of several years Karen Weinstock, the manager of our firm's Atlanta office. Karen moved to the US from Israel and I was her immigration lawyer. Prior to coming to the US, Karen was an intellectual property lawyer in Tel Aviv at one of Israel's largest law firms. Karen originally planned on focusing her practice on corporate and intellectual property law,...

hi,
I am unmarried son of citizens of usa and have my priority date current.I filed for I485 adjustment of status to permanent resident, which earlier got rejected, but then on refiling,I got a MSC receipt number saying next process is biometrics
My question is that as I am presently on student visa and my classes are starting from august 17th.Do I still need to maintain my student visa status and enroll in 12 minimum units,or is it ok If I don't enroll and just wait for my further case processing, and I won't be considered out of status as my I-485 adjustment of status is being processed? Is there still chance of my I-485 being denied(I don't have any criminal or any wrong record and maintained my status prior to filing my I-485 adjustment of status). Please guide whether to still enroll in 12 units and be on student visa or is it ok if I don't enroll as I no more want to pay high fees but,am worried about maintaining my status.

Hi All,
I am sure this has been discussed in detail before but I couldn't find the related threads..So i am posting it again..Sorry for the spam..
My wife converted from H4 to H1 last year (H1 started Oct 2007). She has been working for the H1 sponsoring employer since 10/1/2007...She plans to take a break now and relax for a few months for personal reasons...Can we update the I-9 form with her EAD info and work for a few days and then take a break...I know by doing this she will lose her H1 status but we are fine with that as she will be using her EAD moving forward...I am a July 2nd filer with 140 approved, so I dont see any risk in my I-485 as it is a pretty straightforward case...Have been with only 1 employer since Jan 2001 with PD: Nov, 2003 EB-3 India.
I just wanted to check if this is ok...Any thing that we need to look into before changing the I-9 to EAD....
TIA.

Well, if you leave your co. now and also want your GC then:
Your H1 period will be over after 6 years irrespective of the I-140 from the old co.
GC: You do have to start from scratch.
However, you can still maintain your PD if your prev. co does not revoke the I-140. The documentation of your Old PD is to be attached with the New I-140.

I found some information that I believe could be beneficial in knowing the status of the pending I-140 case (also for I-485)
This is called TSC Streamline procedure and a url link is given below.
Based on that, AILA attorneys can send an email notice about the pending I-140 info. It seems like the application should have been filed prior to the processing date that shows up for I-140 for TSC. It looks like there is no 30 day window imposed as in the case of Service Requests.
This email is supposed to inform USCIS about our pending I-140!
Here is the link.

Admin: Pls. delete this thread if this subject is already discussed.
I searched and couldnt find any relevant links.
Hope this helps!

Is the PERM sponsorship email sent from DOL to the HR representative of the company automatically generated or is it sent after manual review of the application by the authorities?
Out first PERM application was denied and the attorney refiled it again on the same day saying it was because one colum was not filled in.
We refiled on last friday and still havent received the sponsorship mail this time too. Again the attorney tell us it is possibly because monday was public holiday.
I was under the impression that the sponsorship email is automatically generated as long as all the info is correct.
Any idea if the attorney is right on this?

I gave first FP on 9/28 and lat month I took info pass and the officer raised a SR for non delivery of cards to which I got a reply that my card might have lost in mail. I called USCIS who mentioned that my card was never created and now it will be created. Now my online status changes mentioning that I have been sent FP notice again. I called uscis again and mentioned that I already gave biometrics
The officer said it was erroneous so ignore the FP notice and he will be requesting CPO for me. I even called FBI FP line today to confirm that my first FP was fine and they said it was fine and uploaded
