I completely agree with DSLStart. We are paying Monthly Mortgages, property Tax and Insurance for Home. and contributing to Economy So Please include Current Homeowners also.
Current homeowners who are waiting for their GC MUST also be exempted from cap. This clause has to be there. Without having any gurantee of getting GC these folks have invested their savings in buying home even when the prices were high, WHY because they had real intent of making US their permanent home. So these people should too be exempted from EB cap.

I am working with my company for last 3 yrs on H1-B. I have an approved I-140 and I am filed under EB3.
My H1 expires soon and the employer is going to apply for an extension. After that, they plan to file a new labor for me in EB2 and port the EB3 PD; once the EB2 I-140 is approved. My current title is "Software Engineer". They plan to file me as "Senior Software Engineer". My experience before joining my current employer was 7 yrs.
Is this a legally advisable/feasible scenario? I do have EAD and want to make sure I keep my options open. Given the current scenario, it may take a while to get the new EB2 labor and I140 approved.
Is there is a risk to my existing approved I-140 in this?

If the law is followed in the enforcement then that is fine. Integrity of H1b program will be maintained. If arbitary and against the law then that should not be followed.

Well.. may be because we don't have any legislative issues to talk about until congress comes back from recess in November. By the way, how do you know that this practice might be ending soon. I know DOL was considering this and was receiving inputs back in April but nothing came out of that. They have thought about this before and they are thinking about it again. DOL knows that this system is being misused to the fullest extent and want to put a stop to it but they never do due to the pressure from companies misusing them. Why do you think DOL will act now? I have my doubts that anything will be done.
I have seen at least three thread in the past that discussed labor sub bashing. So you guys made your point, it is an evil practice and it screws those standing behind. This theory that 'AILA/AILF lawsuit threat overturned July VB' is out of touch with the reality. Threatening lawsuit was bad for AILA. They were not involved in the discussions that finaly resulted in reversal. IV was a participant but AILA was not.
We shouldn't repeat their mistake. The moment IV files a lawsuit, USCIS will stop discussing with us. We will be off the discussion table. Only place they'll talk to us will be in the courtroom. We also shouldn't forget the pressure applied by Congresswoman Zoe Lofgren on USCIS and DOS. She was ready to wash their dirty linen in public. No doubt, she was influenced by rally in San Jose - which happens to be her constituency.
3 year EAD/AP, AC21 interpretation are rules that USCIS makes, there's no way a judge can dictate what rules a government department should make. You wrote "there is nothign to lose but a lot to win" . Like someone pointed out we won't even be recovering 10k -20k spent on it, even if we win. We'll be getting into a case which has no chances or very slim chances of winning.
If we lose the case, there's no going back to discussions with USCIS. They won't be entertaining us after we sued them. It's a grave risk you should understand. I feel tired at having to explain it the Nth time to some of you who still consider AILA as a messiah. Nothing happens because of just one factor. It's a combination of several factors that ultimately produces results. There are no silver bullets that fix every problem. Its the reality.

If congress would have done it's job properly 60 years back, there was no need of nuclear deal now. The comment you made makes it pretty sure that congress was a failure since last 6 decades. The benefits of current nuclear deal will be in next 2 decades. So what poor people of India eat in next two decades? Will you tell them that don't worry...hang on for next 20 years. If we do file a lawsuit against the discriminatory country-quota laws in EB immigration, in worst case scenario, even if we loose it might help highlight the issue and send a message to Washington that we are serious and we mean business. And the judgement might help us at-least get the recapture visas back if the court is made aware of our plight.
IV has spent so much money on Patton Boggs etc. . Maybe its time we think about this option as well. Maybe this method might work as clearly other approaches have failed and we haven't gotten anything. And before the IV loyalists jump on me and ask me to contribute first, yes if there is a lawsuit by IV, I will happily contribute my half-month's salary to the cause.

You need DOB certificate at I 485. I am not sure whether Police Certificate is needed at 485 stage or not. What I am curious is will the USCIS accept DOB certificate from the Indian Embassy or would require it back from the applicants place of birth. A person whom I know has recently requested for DOB certificate and it took almost 45 days in his native place in India.

........I strongly beleive that the H1B system and the EB greencard system has been setup to legally bring in high skilled workers as slaves and exploit them by taking away their freedom. We are no better than illegals, in the way we are treated by the goverment and the employers.
I will fight this case atleast to try to prove my point before I leave this place.
I am looking for some civil rights agency which can help me with the lawsuit. My fight is not for the GC, but it is for justice.

My advice to you, this forum gives members a chance to voice their problems and many members help with suggestions and experiences. IV works for relieving our problems - and if their intentions are on our side, we need to help them and not fight amongst us or them. Judge by what the administrators of this org say.

There is difference between a common man and a celebrity. We did make noise about Abdul Kalam and Fernandez when the news came out. I think SRK was right to make an issue out of it.
I have been through secondary once and frisked about 4-5 times as a "singled out" case. Man I hated it, whole flight was watching what was going on. What if I make an issue? It will be dismissed as everyone goes through it.
When I went for secondary exam , I was released with 5 mins of questioning but was made to wait 30 mins. The secondary officer was nice, but the primary inspection officer was really mean. She picked on me coz I was smiling in the queue and talking to other people. and I laughed at the jokes cracked by other immigration officers.
3 out of 4 frisking incidents were insensitive and derogatory.
But voice of celebrity has more credence to it.
