I have a question. I am a July 2nd 485, EAD, AP filer and I did not receive my AP yet. My H1 visa stamping got expired, and I am planning to go to India for 2 months. Can I leave US before my AP gets approved, hoping that it will be approved in the next 2 months time and my attorney will send the AP papers to my India address?
Is it possible, please advice.

If you have a job, getting a work permit will take only 4 hrs inside the consulate. No line. Give the passport and come back within 4 hrs to collect it.
No labor certification for computer(s/w for sure, dunno about h/w side for sure) professionals or petition. Need to show offer letter from the company and letter from company to the consulate.
1. Post on canadian job sites with local canadian address
2. get an interview call, canadian employers do not do interviews over phone like in the US. They ask for personal appearances.
3. If you land the job get an offer letter
4. Take the offer letter to the CCanadian embassy and get a work visa.
5. Once you enter Canada apply for Permanent residency.

Does USCIS usually says this. i assume it should say "AP approved " or something similar. Have anyone seen this message on tracking your online case status.

I'm coming to the US for the first time on H1B. Do I need a one way or a return ticket? My travel agent told me that since I have a multiple entry visa (expiring on Oct 2011) a return ticket is not required unless I need to travel back home within one year. Could someone with knowledge about this issue help me out. I would really appreciate a reply from someone who recently landed in the US on H1B.

Ajju, Mine & wife's applications for 485/EAD/AP reached Nebraska on 07/25/07 and I have receipt dates of 08/27/07. I'm yet to receive it from my lawyer. Found out the LIN #'s from the back of my encashed check. No finger print notice yet. I do not think every one who filed between 07/17/07 to 08/17/07 will have a receipt date of 07/17/07

8/27 should be your Notice Date... per online status it will say received on 8/27.. but its ND... Once you get physical receipts... the RD has to be 7/24 in all normal scenarios... But for July fiasco filers.. I think it could be just 7/17... Update once you get the physical receipts.. I may be wrong... just noticed this in one case only yet...

Hi All,
I am in a strange situation. I was on H1 and applied for H1 extension, I also applied for F1 and got approved for that. Once I received my F1 approval I told my employer to cancel the processing of H1.
Now my employer says that the H1 was approved. Now which status I am in is the main problem. Can I find out which status I am in by any means? what happens if my employer cancels the H1 will i be on F1 or is my F1 no more valid? please can someone help me as I need to take a decision immediately.

I was employed by company A until from 2004 thru May'07 with labor and I140 approved in 2006, I was laid off from Company A in May'07 therefore I joined company B in June (transfered my H1).
In July , Company A agreed to file my I485 under future employment as all the EB catagories became current but I still work for company B (H1 with company B), now since in Jan'08 it will be past 180 days on my 485 application.
Can I file AC21 to change my employer to Company B and continue my I485 through to Company B?

If appropiate can one of the administrators tell us how much of the funds collected thus far have been used (for whatever purposes). I am not asking where the money went :-), just basically how much is left in the Kitty now. If we are running low i am hoping we will see a spur of new donations..

1. I came to US for work and have found US to offer challenging work environment full of opportunities. After working for 6 years, I would like to upgrade my skillset and hence, the decision to go for education
2. In this global economy, it is hard to plan exact details, but I believe that with my US experience and added education, I should find a rewarding position anywhere in the world
3. I've attached the papers of my home in Pakistan where I intend to return in the long run, but most probably I'll have to move to the place where I'm offered the job after my education
Of course, there is no gurantee that the USCIS will respond positively to honesty, but at least your friend's conscious will always be clear.... good luck to her!

1) The individual must be EB1 or O category; and
2) The individual must have correspondence from the US government documenting the absurd red tape (a letter explaining the delays in their green card, etc).

Did you get the finger Print Notice?
My case was also transeferred from NSC to CSC and then back to NSC. I got the receipt and tranfer notice but no finger print notice yet.
I wanted to find out if you got the notice for finger print.

I�m in EB2 and My I-140 was approved September 2008 through Employer A. And I got laid off on November 2009 from EMP A, within 15 days I joined another Employer B. As per policy, employer B is not going to file GC for me. Already I spend 5 years on my H1B. I check with EMP A�s HR dept, they will not revoke my I-140 and H1B. I know AC21 is one of the options to transfer (Portability) my PD to Emp B after apply I-485.
It would be great if I get answer the below my Question:
1. If my PD is current, Will I eligible to apply I-485 using Employer A I-140 approved?
2. What are the documents needed from employer A, if I want apply I-485?
3. All my friends telling me, I can apply I-485, Is it true?

I got my 45 day letter last month. The letter came to the Lawyer's office who faxed it to HR. HR director signed it and returned it to the lawyer who then posted it back to BEC. I looked at a copy of this letter. It is very straight forward. It only requires the attention of employer and/or lawyer. The employee does not figure into it at all. So, follow up with employer (HR) and your lawyer about it. But do not delay. If BEC does not receive a response within 45 days they will mercilessly close the case. So, beware!

This Cashiers check was created in end of June 2007 ( generaly validity till Sept 07 (90 days). Application was mailed in end of July by Attorney.
Now based on general application process, i am worried about my cashiers check being invalid before USCIS cashes the check and they may cancel the application.
Has anyone else had such an issue, & what is solution to this problem.
Please suggest.
