Can I apply for H4 along with H1B (my spouse)? If not, when is the earliest time I can apply for it and in average, how long will it take to change of status from F2 to H4?
Also, If I am currently under F1 visa, can I change of status to H4 while studying? Is there any requirement that I have to change of status from F1 to H4 before I complete my studying a number of specified days/months?
One more thing, I heard that if I have Canadian PR, I am allowed to work in the US, is that right? If so, how long can they work in the US?

wow that's a long wait to file your labor. Well in any event you got your GC and i wish you could have gotten it sooner since IMO you should have filed your labor much sooner. Good luck in all that you have planned on doing.

I think Houston is processing the cases quick....I am impressed with the turnaround time.

Hi guys, Just wanted to post an update here. Me and My wife got our GC's in mail today. Our PD was May 19th 2006. Interestingly there is no update on my case online. I was very anxious and refreshing the case status page every few mins for the past few days but to my surprise, my case was approved on 5th of May and i have the cards in hand now.
Keep your hopes high and have patience. It could just be that USCIS has stopped updating the online status and started working on our cases(Wishful thinking :))

My PD got current at today's Visa Bulletin. Presently I live in SF City, California but we are in the process of move from California to Texas. We will be finally move to TX during Sept-2007. My questions are:
1. Can we move from CA to TX after I-485/EAD/AP is filed from California?
2. We do have a PO address is Texas now and have an apartment in CA for next 5 months.
Do you recommend to use the Texas PO Box address instead of California Apartment address for USCIS I-485 application such that we can avoid the Change of Address with USCIS later?
3. What are RISKS of moving from state to state during I-485 process? Did anyone do that in this forum?

Usually at this stage, RFEs are for Employment verification. Did you use AC21 to change job or roles? Did you change your house address?

Simly these guys want to derail the whole discussion either it is EB3 push or visa capture or any kind of fruitful discussion.
I know it is difficult to stop creating and screening ids, atleast can you delete some unrelated postings and make sure that there is some healthy discussion continues and people like me wont stop visiting IV.

The online status that we see currently on USCIS website can be improved to a great extent. $$$ spent to improve the system will be recouped in few years with savings elsewhere.
Current status: The two primary ways the USCIS connects with its customers are USCIS online case status and monthly processing time update. They both are expense free unlike a CS agent that handles the call and needs to be paid. But those two primary methods are a butt of all jokes and useless in its current form.
Objective: Improve the quality of USCIS online status by integrating it with monthly processing time update. Any case which is beyond processing time frame should get atleast one qualitative and progressive update every month. Institute a system to track the lifecycle of a case. The lifecycle starts from entry of a petition/application into USCIS system and ends with either approval/denial.
Pros:
1> provides a great deal of transparency to the system. Due to the improved transparency, efficiency becomes a part of the process.
2> Reduce the traffic in USCIS phone lines thereby reliving $$$ from customer service.
3> Reduce Infopass appointments thereby relieving maintenance $$$ from that system.
Officers who deal with Infopass can spend their time productively.
4> Reduce SR. Saves Immigrants $$$ and relieves USCIS resources who are handling SR request.
5> This improvement is not temporary and will keep yielding rewards as long as the USCIS is in the business of receiving/processing/adjudicating immigration petitions.

1> USCIS needs to shell out a good $$$$ to tighten up their IT system, gather info from systems, integrate the online reporting tool with their monthly processing time update.

I am in a similar situation. My wife who is on H1B did not worked till date.
Is it possible if she carries the vacation letter from the employer and go to India for H4 stamping? My wife do not have any paystubs.
I have also contacted my attorney and waiting for his response. I am running out of time due to the GC priority dates being current. If the attorney does that while she is in the country, it would take around 4-6 months. By then, the priority dates might be retrograted.

It will be very difficult to argue unpaid vacation for > 50% employment time. There is alawya a risk of getting Change of Status approved without I-94 and could result in I-485 denial if out of status > 180 days.
Out of Status is NOT an issue for H4 visa stamping.

Looks like NSC is also approving I-485's. Not sure how long this trend is going to continue, guess all depends on how much visa numbers gets trickled down from other categories to EB2 India / China. Hope and wish they are many.. which would helps many people waiting in line and PD not getting pushed back for FY '10. I feel bad for EB3 folks though, seems like nothing going to change for them at least in near future, untill there is some congressional action. Hopefully the next VB gives some indication on how things are going to move. Good luck and wishes to all who got greened, especially with older PD's who have been waiting for years. hope USCIS/DHS have not already replied and we are not ware of it, making july 2nd fiasco an ordinary thing rather than extra-ordinary.
Keeping my finger cross that something positive will happen as a result of this letter and will not bite us later in the process too as someone said here throwing all these apps in cold storage.

Having a tolerable time ensures that USCIS processes all the applications they receive in reasonable time. Eliminating renewals reduces lot paper work, money, time and energy. If this is considered as unacceptable I do not know what one should expect. I just wrote what I think is meaningful. If have a better idea, please feel free to comment. But stop commenting on other. That will only spoil the good spirit of the members in this thread

It is quite childish to create a new id every time you want to say something negative. Your message may be simple and straight forward, but it lacks the integrity or any trust worthiness.
This thread has gone anywhere. It could be simply because of the lack of EB3 I members participation. There is a definite lack of support from the vested parties and a few are discrediting this solution from getting traction and to top it all, I don't see any rational explanation against this. All I see is uncivilized personal attacks, self gloating and people who love to have fun at the misery of others.
As I said before, I will go ahead and do research on what we can do about it and use my years of invested social capital to see if I can do something about it. Once I get some thing substantially done, I will come here for support.
For the "skillz" person, I personally enjoyed your rants. I have/had chances to know personally and professionally many Stanford graduates, I believe they are not as much as fun as you are. :)
