If we are claiming to be best and the brightest having high skills and inventing then it is EB1 and EB2 mostly. It does not matter you are masters from Harvard but by law, if your job requires just a bachelor degree then you are doing basic work at lower management. Legally EB3 have no case if they claim to be best and the brightest inventors. All doctors get EB2 or EB1. All managers with advanced degrees get EB2. All Scientists and PhD holders get EB1 and EB2. So EB3 is mostly people who are low skilled programmers, people in professions doing lower line work or people who despite having higher degrees are doing jobs that do not need advanced skills to be the brightest folks immigrating in USA. There are some exceptions of people who are screwed by their lawyers and employers by forcing them in EB3. These people should fight with their lawyers and employers or change their jobs to EB2. EB3 do not have a strong legal case to fight for EB3 if they claim to be best and the brightest. Bring the border control, and add in tough enforcement on business that hire illegals - and then you still will have to address the people who are still here illegally. It may not be 12 million, but millions will still remain. That issue has to be addressed. The current president has said that they are to be a given a "path to legality" - pay the fine (yes, it may be trivial in our standards, but not theirs) and get in line. It is not blanket amnesty either.
Yes tough border control and employer monitoring should be there. Progress on the second is improving , a bit slowly.

We cannot have 4 million legalized and 3 million criminals hiding in the background. Also as CIR says only after the border is 100% secure, else you will have 10s of 1000s jumping the border everyday when this bill is passed.
Well the illegals kids also already got citizenship/amnesty in the millions.

There are about 30 million Mexican immigrants, in the US, probably 15 million legally present. Most immigrant in EB3 from Europe and around the world are also affected.
There are probably about 30-40 million people or more Citizens/ GCs/immigrants , from retrogressed countries in the US..

Finally I got the email for Renewal EAD card production ordered.
I e-filed on June 11th. Did the finger printing on July 11th. card production prdered on Aug 12th. Still waiting for the card. will update with the validity of the period once i have it in hand.

Schiff has repeatedly stated that he does not believe in amnesty for undocumented aliens, but he does believe that those who have been living in this country -- working and paying taxes -- should be given an opportunity to embark on a lengthy and hard-earned path to citizenship. However, he has made it clear that he does not support immigrants who are here illegally being rewarded for breaking our laws by jumping ahead of those who have sought to enter this country legally."

I just called all the offices mentioned.
Almost all of them seemed to know what I'm talking about and couple of the offices actually said they have been receiving numerous calls asking the congressman/congresswoman to support these bills and some of them knew the bill number even before i could mention them...so looks like we are getting our point across loud and clear....

Since people would be filing taxes early next year, and most expect some returns from Uncle Sam, how about starting a thread to pledge $ 200 from tax returns?
Also, someone had once suggested IV set up a mechanism via Pay Pal to make auto deduction of say $ 20-25 every month. That should get it more continuing contributions and help even out IV's cash flow.

I think PD recapturing is the only solution. We don't know if CIR will pass in 2010 or 2011. Neither do we know that if that is good or bad for legal immigration.
Guys we should work with IV to get the PD recapture.

Just checked USCIS.gov. Both mine and my wife's I-485 were approved.
"On May 5, 2011, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283."

Me and my wife are both on H1 approvals (F1-OPT-H1) and planning to go to New Delhi for our very 1st H1b stamping and I was wondering if I can do the same and Book just 1 appointment for me and my wife and appear before the VO together at the same time?

In this visa bulletin atleast they give us an idea of not to expect until the year end, So they are not giving false hope in each bulletin until october 2009!!!
So we all can predict on september onwards. Atleast we should send some flowers for passing this information.

Mine is similar to yours. Paper filed and receipt date 4/2/2010. LUDs on 4/8/2010 and 4/13/2010 (exactly 1month till today). Still waiting.
E-filed EAD and AP Renewal on 2nd April.. Sent documents after a week.. Received couple of LUD's and the last one on EAD application is on 04/22/10 and the application is still in Initial review. In case of AP the LUD is 04/07/10.
Not sure if someone else is in the same boat??? Should I try calling USCIS??

I think you can file for I-485. But, once your GC gets approved you will have to move back to VA for a month or so and work from there. Remember GC is for your future job. Anyways....talk to an attorney.

I talked to a staff member at senator Barbara's office, and the staff member said, Faxes and emails are responded and replied by staff reps. Only written (typed) letters go to Senator's attention. She also advised me that if this is something you need the senators attention on, do not send fax or email, send a letter with postage paid.
I explained to her the visa -flip flop, and she said most likely the senator will read and send an inquiry, The senator is very good at responding to letters from constituents.
That is exactly why we need to send them letters, please look at the format and add some personal details, gives it a little personal touch.
I agree. My experience thus far: I emailed 200 reporters and received no response. I am going to try the letters idea, because I too think what Amitjoey says is right-- letters make an impact.
Write a letter, run a grammar/spell check, then print, SIGN, and send it to senators who support us. I wrote the following. But please personalize, because that would send the message that this is an issue of importance to you-- the writer.

With this bulletin, DOS determined that all the immigrant visa numbers allocated for the current financial year had been expended, and thus there would be no further authorizations of new Green Cards this year. In response, USCIS announced that it would return all Adjustment of Status applications it received, beginning July 2, 2007. Please note that the USCIS had already RECEIVED applications on the morning of July 2, 2007, even before DOS published this interim visa bulletin.
In my opinion it is an unfortunate decision in that it virtually renders null and void, thousands of properly filed Employment Based Green Card- Adjustment of Status applications.
An important thing to note here, is that in the Visa Bulletin published by DOS only 18 days ago (June 13, 2007) all Employment Based categories had been made �current� since almost 60000 immigrant visa numbers had been unused till that time.
This begs the question: how did USCIS manage to approve about 60000 green cards in less than 3 weeks, when it took the previous 8 months to approve the same number of green cards?
The Visa Bulletin published by DOS in June 2007, had brought good news to thousands of high-skilled temporary workers (doctors, engineers, IT professionals) in the USA, because the floodgates that had been closed for over 2 years had been re-opened.
This bulletin had implied that we could finally apply for "Adjustment of Status"- the final stage of the 3 step Employment based Green card process. This would solve a number of quality of life issues for people like me, as they would allow our spouses to take up part or full time jobs, they would bring in an element of stability allowing me to plan the purchase of a new home, and it would give me the freedom of relocating to another part of the USA for any unforeseen reason, without worrying about the portability of my existing job.
Therefore, my family and I worked really hard, and tried to religiously comply with all procedures laid out and submitted our application to reach the USCIS on the morning of July 2, 2007.
Besides running around to gather the paperwork to help file in time, I had to spend a significant amount of money on:
1) Urgent medical examinations and vaccinations by USCIS approved surgeon: $700. (Note: These were not covered by my medical insurance.)
2) New passport photographs; these needed to be less than a month old... so these had to be newly taken photographs
3) Notarization/ Courier charges: Approximately $100 (Some amount expended in foreign currency)
All of the money spent, as well as the time and efforts were rendered useless by the new bulletin on July 2, 2007, which I repeat, was published AFTER the window opened for new applications on the morning of July 2, 2007.
My point is, and I believe anyone with common sense would agree, it is only fair to expect a notice period before a reversal such as this one. Preferably... weeks of notice if not days! I am sure no US Citizen would accept anything less for a notice in such an important matter!
I would implore you to look into this matter as soon as you can, and request the USCIS to accept Adjustment of Status applications filed through July 2007.

The Visa Bulletin published by DOS in June 2007, had brought good news to thousands of high-skilled temporary workers (doctors, engineers, IT professionals) in the USA, because the floodgates that had been closed for over 2 years had been re-opened.
This bulletin had implied that we could finally apply for "Adjustment of Status"- the final stage of the 3 step Employment based Green card process. This would solve a number of quality of life issues for people like me, as they would allow our spouses to take up part or full time jobs, they would bring in an element of stability allowing me to plan the purchase of a new home, and it would give me the freedom of relocating to another part of the USA for any unforeseen reason, without worrying about the portability of my existing job.
Therefore, my family and I worked really hard, and tried to religiously comply with all procedures laid out and submitted our application to reach the USCIS on the morning of July 2, 2007.
Besides running around to gather the paperwork to help file in time, I had to spend a significant amount of money on:
1) Urgent medical examinations and vaccinations by USCIS approved surgeon: $700. (Note: These were not covered by my medical insurance.)
2) New passport photographs; these needed to be less than a month old... so these had to be newly taken photographs
3) Notarization/ Courier charges: Approximately $100 (Some amount expended in foreign currency)
All of the money spent, as well as the time and efforts were rendered useless by the new bulletin on July 2, 2007, which I repeat, was published AFTER the window opened for new applications on the morning of July 2, 2007.
My point is, and I believe anyone with common sense would agree, it is only fair to expect a notice period before a reversal such as this one. Preferably... weeks of notice if not days! I am sure no US Citizen would accept anything less for a notice in such an important matter!
I would implore you to look into this matter as soon as you can, and request the USCIS to accept Adjustment of Status applications filed through July 2007.
