Hello Gurus,

My wife is on H4 since 2004 and we filed H1 (Jan. 2007) and her H1 status is pending at this moment. I am about to file 485 (July 2007 current bulletin) very soon.

I have mentioned that she is on H4 in the I485 related docs. I thought her H4 becomes invalid ONLY after H1 is APPROVED. Is this correct? Please let me know.

I have H1 from a consulting company.Now the client I work for has asked me if I'd like to join their company.The problem is they won't sponsor H1's.I'm willing to talk to an attorney and pay expenses for transfer.Can someone tell me if it's possible.If yes then what are the supporting documents we need from the client to transfer?

Hello,
I will be getting married to a H1 holder in India and because of the time involved in obtaining a marriage certificate, am planning to leave shortly after the wedding with my existing B2/tourist visa. What are my options of applying for a H4 once I do that - would I have to come back to India to apply for that, or can it be done from Canada/Mexico - are there any risks pertaining to intent of travel associated with such an action. He can do that, but there is a chance that the CIS will reject the change of status application on the basis of preconceived intent. If he does come here, he should wait 60 days before filing the change of status application. My recommendation is that he apply for an H-4 abroad and then enter using the H-4 visa.

Hello,

Here's my situation:
H1b: 7th Year (valid through Nov 2009)
Labor: Approved
140: Approved
Category: EB2
Priority Date: Aug 2007
485/EAD: cannot file due to retrogression

I have a permanent employment offer from the employer where I am contracting, right now for the same job. Following are the questions I have:
1. Can I change my employer?
2. Can I retain my Priority date?
3. If the new employer files for transfer of H1, what does it mean to my extension beyond 7th year?

Please help.

U need to start the GC process all over again, unless ur current employer is willing to support you in filing the I-485 without revoking the I-140

I am in similar situation. SSN office refuses to give status on phone. So I have to go in person with 2-3 hour wait. Then the lady sends me back saying - "it can take up to 12 weeks".

Any ideas?

A quick question for all you experts out there

My wife is on H4 right now and I am on H1, though we got our EAD last year, but I am still using my H1 and not used my EAD yet, So is it possible to apply for Social Security for my wife, will applying for Social Security Number, considered as using EAD and H1 becomes void.

Use of EAD to get SSN is OK. Don't use EAD for work.

I went to Baltimore USCIS FP center.They ask ID at the counter only if you are getting your fingers printed, and this counter is actually tokens issuing counter inside, there was no security or anything at the entrance.I have seen several families with kids.I guess it is going to be the same in other locations.

My wife and I are scheduled to go for fingerprinting this month. We have a year old son and obviously we are planning to take him with us as well. Do I need to take any form of ID / birth certificate of my son (obviously he is not to be fingerprinted) but not sure what the rules are with respect to carrying infants for the interview. Anyone who has fingerprinted in a similar situation?

I'm curious if anyone has got multiple RFEs on their I-485 application. I had an EVL RFE last year and wonder about the chances they'll give that (or any other) RFEs again in future.

Any personal experiences?

By multiple RFE I don't mean many questions in 1 RFE letter. I mean USCIS sends you 1 RFE, receives reply and resumes the case and then at a later point in time sends another RFE on the same application.

No personal experience but based on recent visa bulletin and slow movement prediction going forward I would not be surprised if they send another EVL RFE, especially if your PD is more recent. This is because if and when your PD is approaching to be current, that could take 2, 3 4 or even 5 years. They may ask for EVL again to verify you still have a job offer after 5 years.

before my I-485 status "runs out" ?

H1, H4 (spouse) and H4 (kid) living happily.

File 485 and gets EAD/AP.

H1 doesn't use EAD.

H4 uses EAD and hence looses H4 status.

I-485 is denied.

Now, my understanding is that spouse has to go out of country and come back again on H4.

What about the kid?

When does the kid loose his/her H4 status? (When both mother and father use EAD)?

As long as primary stays in H status any derivative who does not change his H4 status will stay in H4 status. the only way a H4 can loose H4 status if he/she uses EAD. In your case if i have understood it correctly ur Kid will never use EAD and if you never used EAD ur H1 status is active thus ur kids H4 is active .. also i think ur wife can change her status back to H4 but would require her to file some paperwork .. she might need to geta visa stamp when she tries to re-enter into us..
