I am not sure how USCIS will interpret the above section as well.

Guys,
Happy to inform that on 89th and 90th day (respectively) both me and my wife got the CPO emails. We had filed on may 21st and had fingerprints taken on 6/11. You can find our details on the second post on this thread. Waiting eagerly for the cards now, hopefully 2 year.
Good luck to all of you!
Mhathi.

There is a perception on this board that renting => no quality of life. After going through some of the replies, I see that some are trying to convince themselves of their decision to buy an house.
If thats a perception, let me tell you its not truth for me. We are very happy in apartment.

I take strong exception to following statements:
"The US masters degree holders, particularly with computer masters degrees with their courses in useless subjects like "assembly level programming" and their binary math didnt do squat for them while looking for jobs during recession times and could not stand competition from bachelor's degree holders from Tier 3 university from India who had done 6 month course in NIIT. "
The above statement is completely wrong. I needed assembly level programming and the binary math for designing satellite switched routers. There is no way to get packet processing time to less than a micro second without knowing assembly language and binary math. I have been in R&D for 3.5 years and I can assure all of you who are taking these courses that these courses are very relevant if you are looking for a job in high computing and high performance industry.
In addition I passed MS in 2001 and alongwith many others went through the same period of 2001 job market!
and why do you think those courses are not taught in a foreign country?

If EB3 ROW becomes current, do you need to have an approved I-140 to file for I-485 or Can you fill I-140/I-485 concurrently?

so, let's say my date becomes current in June.
And then I get a call from USCIS asking me if I prefer in store pick up or home delivery ?
What do you guys suggest , should I opt for instore pick up ;) ?
(as far as they do not hand me a rain check when I reach there...)
last time they asked me this (as mentioned last year on this forum) I said whatever you please and they decided not to complete my order....

There are tens of thousands from retrogressed countries who have been stuck for more than 8 years (PD 01 and 02). Most of us were either stuck in namecheck or BEC blackhole through no fault or ours. Still there are others who were screwed by employers and had to reapply labor and restart the GC process. When i talk to my congressman, all they say is that the PD is not current and they cannot help.
Great point! When I reach out to the Congressman's office, none of them are aware of the inefficiencies of the last few years that has resulted in the current backlog of AOS for folks from India, China etc. For example, my case was stuck in the BEC blackhole (transferred over just when it was about to be processed by State office) for well over 3 years when there were a significant number of Green cards available. However being in EB-3 India category, the dates today are not current even for my PD of Dec 02. Unfortunately, the Congressman's aides are only aware of current status and claim helplessness to do anything until the dates progress. Given this, we really need to talk to senior officials/ Congressional Sub-Committe members who are a little more aware of the details and understand the significant waste in the past that has led to current status.
Totoro, any suggestions to overcome this issue would be welcome. Great job btw - keep it up!

Hello Susie,
My daughter accompanied me on H4 visa. My labor was approved in June 2006 and she turned 21 in July 2006. My I 140 was approved in Dec 2006. I have received valuable inputs from IV members and understand that she has aged out. I believe that things can be simplified if unmarried children under 21 who come as dependants of workers with dual intent visas or similar catagories are exempt from ageing out rules. This may avoid lengthy rules, computations, complex interpretations and possibly lawsuits.
I would be most interested to see the evidence supporting your statement and the information you have received from IV members. Since in one breath you are saying your daughter has aged out and in the next you are suggesting she is exempt from aging out rules???

Slammer, if you got visa number last year you should have gotten an interview months back, UNLESS your consulate appoinment schedule is backlogged.
Good luck
We called the NVC 2 days ago about the status of our application and the guy on the phone (who was, BTW, very polite and patient) told me that everything was processed and as soon as our PD was current we would get an interview appointment very soon.
We also sent an email-inquiry to the NVC last week and just today we got the reply :
"Unfortunately, this case no longer has a visa number available. This is
because the applicant' visa category is oversubscribed, meaning that
the available numerical limit of visas able to be issued was reached.
Upon reaching the numerical limit of visas able to be issued, only
beneficiaries who have a priority date earlier than listed in the current
Visa Bulletin may be allotted a visa number in this visa category. "
So, that must mean that they had a visa number for us back in August 2007 when they sent us the DS230-I and the bills for the visa fees although according to the VB for August/September 2007 EB3 ROW was "U" ?
Hmm, I have to admit that I have kind of given up on understanding how this all works. I'm just looking forward to that day when we finally receive our GC and are able to move to the States.
Good luck to all of you and even more patience !

Hi All,
Regarding my I-485 appln. status - I do vaguely remember seeing "Request for Evidence" status before. Currently I see "Request for Evidence Response Review". I see this status change although there are no LUDs.
Throw in your input Gurus !
Thanks
