we are highly sklilled smart and great immigrants creating the new America of the 21st century we can't just say, thats it lets wait.....
This country is about money, and we have the tremendous advantage that elections are coming, lets see the big picture.. why dont we jump to the next level from street protesters to work with one of the candidates or 2 or 3 , if they see money they will push our cause. Lets work on that now...
So those guys who attended the hearings or met with senators. what was the result? what did they accomplished? did they get the opportunity to participate with the senator or law maker in an action plan? or we just wasted that opportunity asking for autographs? please those guys post your comments.

I know the RD (which is printed in our paper receipt - ie day when USCIS received your application, and not the date when USCIS mailed your the receipt) is when the 180 day clock gets started.

Iam in the similar situation, but my wife came here only last month on H4. My GC was approved yesterday. Now I have all the documents ready for my wife's GC application to be sent to USCIS. My lawyer also told me to immediately mail the application to USCIS since I did not receive my GC on hand yet.
My concern is will my wife's application get rejected since my I485 has been approved? Pls help!

And, finger prints are usually valid for 15 months, and there is no definite trend as to who is asked for finger prints again and who is not.

Does anyone know how Quebec compares to Ontario. Specifically Montreal to Toronto. Economically, culturaly, etc.?

I have a sister that lives in Beaconsfiels (on the island of Montreal) - so I know what I am talking about ... been there many times.
Depends - do you speak French. If yes, Montreal is outstanding. If not, then TO (said "T" then "O" (not zero)) (or Toronto), is more likely desireable to immigrants. It is extremely multicultural, economically not dependant on a "referendum" (French trying to separate sending the economy for a spin).
Housing in TO is somewhat expensive - remember, that it is the 4th largest city in North America. Look also at Alberta (Edmonton & Calgary), and British Columbia - again housing is very expensive here. May wish to also consider looking at Halifax in Nova Scotia, but most likely will not be your choice. A city like London or Kitchener, Ontario is great - just need the skill set to get a job there.
Conclusion - Ontario is most likely your best bet (and the weather is better than Monteal by a long shot)

As you might have guessed, I am on the EB3 bandwagon because of circumstances that were beyond my control [The filing attorney screwed up :( ]
At the time of my EB3 filing (Feb. 2004) I did possess a Masters degree and more than 5 years of Work Experience and the job responsibility that my petition was filed for, did require a Senior worker with Masters experience. Unfortunately, things didn't go that way and here I am.
I keep reading about some lucky souls [god bless their souls :) ] who have managed to retain their priority dates and converted to EB2.
I really want to do that. I am not sure where to start.
1. I used AC21 and took up a new job recently. Do I approach my new employer and talk to them to see whether they would be able to file my petition in EB2 category? The bad thing is, when I joined them, I told them I don't need any sponsorship or assistance from them. It would be a volte face to go back to them and request them to do something. And the best part is, there is no guarantee that my company would file my petition.
2. Do I look for a new employment and if and when I clear the selection process, do I tell them that the only way I could join them is if they could file my EB2 petition? If they think that my services is a necessity, they might do it else they might look for other candidates. It s like throwing a dice.
3. Do I look around for desi consulting companies that would file my EB2 and in return I work for them (using my EAD) through the EB2 petition/adjudication process. With this approach, the desi companies might do it, but like other people, I also think the reputation of these desi consulting companies is severely dented and there is all the more chance that the EB2 petition might get denied.
Gurus...any help or advise or information is really appreciated.

I filed my EB3 with PD of 2003; due the backlog my company filed EB2 Perm considering the costs for H1B costs and the constraints attached.
If you are working in a full-time job and if they want to retain you on permenant basis considering the risk with EAD they might help you with the process. It is worth checking.
If step # 1 doesn't work then obviously you might need to consider step#2. All desi consultancies are not bad..consider size of the company before you take up any thing..any thing with 300-500 employees might be good to consider.

Look at the state of affair of Tri State, thousands of people like these but only 25 so far signed up for DC rally. Not enough to fill even one bus WHAT A SHAME!

You can bring UP TO 4 spouses on H4 visa. That's why it is called H4. Similarly on F2, you can only bring 2 spouses, Ah...students do not make that kind of money to support more than 2 spouses. USCIS thinks so much about us.

I have a three year bachelor degree + MBA from India with 9 years of experience. My labor was filed requiring Masters degree + 3 year experience with no mention of bachelors degree. Last week, I received I-140 decline (I-140 filed under EB2) citing that my bachelors degree is only three years.
My company is planning to file an MTR with appeal citing 1) My labor only required Masters degree with three years experience and that I have the Masters degree with three years 2) I have bachelors degree equivalent with 3 year bachelors degree and 2 year experience equated to 1 year education equating to US 4 year bachelors degree.
Do you think my appeal would have a chance of success? Please let me know your opinion. I have to file an appeal in next few days. Thanks for your help.

I was also in the same boat in 2005 from New Delhi Embassy..
I had 2 earlier H1B visa stamp from Delhi and this was the third time and this time I got 221 (g) for additional processing...My one month vacation tunrs to three months and I can not tell that was a vacation...it was HELL...I called US embassy so many times...but no one picked up....so many emails..no response...finally after three months got a call that they got my clearnce..nexy day went to embassy and got stamped without a question. I did not get paid for that time period but I had to pay my rents and utility bills from India...
Now my visa has expired and I missed the July boat...so I do not have AP..And I have to go to India for brothers marriage...I am pretty sure this time also I will have to go through this and I heard the name check wait time is 6 months now...I will definitely loose job...so I am in a situation of loosing my job or missing my brothers marriage...And my family memebers do not understand a thing about VISA problems :((. I have emailed New delhi embassy about my situation and asked them do my backgroud check in advance so that I can just go there and do the stamping..but they never replied....It's really frustrating to go through this when you never broke a single law in India and US..(I do not even download anything from web..man...)...

So, from being a law-abiding citizen paying his taxes and doing everything by the book, I overnight became a "threat to the national security" whose background needed to be checked. What kind of BS is that? And why for heaven's sake are you worried about me AFTER I have already left the country on my own accord. Subject me to SC while I am there and deport me if something fishy is found. Don't make me go through this WHEN I MYSELF left the country... Oh! Logic - these F@#$heads don't have that.
I don't even have a freaking traffic violation on my name and here I am. Go figure! thankfully, I have family in New Delhi (I went to the embassy here) and a fast Internet connection to continue working - but for how long?

If this is allowed, every FB applicant who basically is also waiting for a number to complete consular processing would want the same benefits and this could not be accomodated.
CP was good at the time when you could get it processed and get a green card quicker, it would have had to be a carefully planned decision. Now once the choice is made, requesting derivative benefits of AOS would not work. It was always involving that risk.

I think many of consultants those came here with small companies might not got payment initially until you the project ataleast for few weeks. That period of time is the eligibility for illegal status.
Well they will easily find out from your SSN number if one is on payroll or not. I am seriously looking into this matter of getting illegal and many of my friends agree. Once the bill passes in its current form we should get advise from a good lawyer to convert status from legal to illegal. It sounds so insane when I say changing for legal to illegal..but that is the hit thing these days.

It is a feel good factor; you still want to be cynical, go right ahead, no one can take that away from you.

My point is it does not do a damn thing for us workers personally. That money will dissapear into a dark hole in the Indian Gov't coffers instead of a dark hole here, further as the rules stand, I have a slim chance of getting the money from here through social security payments when I turn 65 even if I am in India. Try that within the money in Indian gov't hands.

Hi,
I am joining new job using AC21 provision coming monday. My new employer does not provide medical insurance for the first month. I am eligible for after I complete 1 month.
So my question is: till the time I get medical coverage from new employer (approx. 20 - 30 days), can I invoke COBRA? I heard that one can not invoke COBRA if he or she is employed (only meant for un-employement) is this true?
Also, should I call my current insurance company for COBRA now, or I can wait if I really need to visit a doctor? is there a grace period for this? Because there is a possiblity that I may never would have to visit a doctor for next 20-30 days, but who knows!
Appreciate your answers.

I am joining new job using AC21 provision coming monday. My new employer does not provide medical insurance for the first month. I am eligible for after I complete 1 month.
So my question is: till the time I get medical coverage from new employer (approx. 20 - 30 days), can I invoke COBRA? I heard that one can not invoke COBRA if he or she is employed (only meant for un-employement) is this true?
Also, should I call my current insurance company for COBRA now, or I can wait if I really need to visit a doctor? is there a grace period for this? Because there is a possiblity that I may never would have to visit a doctor for next 20-30 days, but who knows!

The oft-delayed White House immigration meeting is back on the schedule for tomorrow, and is expected to include congressional advocates of immigration reform from both parties.
Peter Wallsten wraps up Hispanic Democrats' frustration, but on balance, any mention of immigration continues to be, for now, a winning issue for Democrats, throwing salt into an open GOP wound.
Harry Reid says he has the votes for comprehensive reform, meanwhile, though the White House has downplayed the chances of getting it done � as Obama has pledged earlier � this year. An open question is whether Republicans have any ability to capitalize on that unfulfilled promise.

I have noticed soft LUD's on all receipts including I140, H1B with all other receipts (485, EAD and AP) for my self and my spouse after using AC21 with H1B transfer.
Not received FP yet and did not call Service center for it.
Any clues? or any experienced the same.

Nice to know that you started the process. Did you send the job transfer letter to USCIS along with H1B transfer or you just did H1b transfer (with plan to send the letter later).
In a way it�s nice that USCIS is tracking all applications together (H1B transfer, I140, I485 for a candidate). It atleast gives the confidence that they are tracking all together and may not get any RFE�s to give them copy of I140 or such.
Please share any updates.
