Wishful thinking - Would be nice if the court went against AZ and asked the congress and senate to resolve the issue soon through legislative action. Republicans will be against any sort of amnesty, so not a thing will happen till November, but there may be chances of piecemeal legislations to address legal immigration issues if Republicans get the majority.
I have paid over $10 K in attorney fees so far and Obama wants to legalize the illegals who broke the law by granting them amnesty and asking them to pay a "fine"? If this happened in our home country, wouldn't we all do the same and think the same as the people of Arizona? I'm in favor of AZ taking this initiative .
I agree with you on amnesty. And I usually agree with republicans on immigration law reforms. Surprisingly, they have been fair. But I dont think AZ new law falls into this republican agenda. I live in Phoenix. I can see the racist motivation behind it.
Ironically, dont forget that if there are no illegals, noone would be talking about any kind of immigration reform!
Here are 3 scenarios, when this law become effective and how it makes legals suffer again!
1) Let us say they stop citizens. They can always say "we are citizens and we dont have to show you any papers". And they are safe that way
2) Let us say they stop legal non-immigrant visa holders, which is my case. In this case, I have to say that I am not a citizen and I will be asked to show papers. I lived in this country for 11 years. My papers are more complicated that even I get confused. And not only that, it is such a pain to carry them all the time. What if I lose them?
3) Let us say they stop an illegal. Since the illegal immigrant already broke the law once, he/she would have no problem breaking it again saying, "I am a citizen. I dont have to show you any papers!"
So what would this law achieve at that time? Just that legals would get more headache!

It is that time again, the eager wait for the next month's Visa bulletin. It is almost like a monthly ritual for many.
Although there is no clear logic to the movements, there are folks in the line that hold some hope that this might be the one that will get them closer to the GC counter. (happens every month ! :p)
Since predicting VB dates is as close to pulling stuff out of thin air. My gaze in the crystal ball tells EB2-I and EB2-C to be the same: Feb 05 (hoping for a quarterly spill over in Jan 2010 :) )
As for Eb3 even the crystal ball turns foggy. I very much wish EB3-I sees some forward movement in the upcoming bulletin; may be at par with or at least close to ROW/China/Mex/Phil.

The reason that the USPS is not showing your documents delivered could be many. One of the biggest reasons that I have experienced is "unable to scan the bar code". This is more probable if you had printed the mailing label and affixed it on the envelope with a tape. Sometimes the tape can overlap the bar code making the bar code difficult to be scanned. I frequently use USPS priority mail and in about 10% of the cases this happens. But I never had a lost priority mail piece.
Additionally the fact that you had a soft LUD on 9/28, I would think that LUD was for the reason that USCIS received the documents. I had applied AP online on the same date as you did, sent docs via priority mail the next day. USPS showed that the documents delivered on 9/25 and had soft LUDs on 9/25 and 9/28.

I've called several members and I am dispointed of them just saying "no.... I can't..."
But they all have time to be in the forums everyday asking for help, asking questions about dates, receipts, etc. It just doesn't make any sense that they have the chance to do something about it, they don't have "enough time for it"
But I am sure, they all complaint about how long is taking and all the money they have to invest on attorneys.

Found this news clipping on an Indian newspaper Today. Below is the Link to the news Article and what it says.It's naive to conclude its gonna happen overnight but the issue of getting back our Social security is catching up!!
New Delhi, Dec. 4: India and the United States will discuss the issue of a totalisation agreement next week to allow Indians working in America to avail of social security benefits that they pay while working in the United States. Visiting US secretary, US under-secretary for international trade, Franklin L. Lavin said, United States and India are trying to reach a closure on the matter and the United States will be taking up the matter next week.
Speaking at a function, held in the capital on Monday by the Confederation of Indian Industry (CII), Mr Lavin, who is heading the largest-ever US delegation to India of 250 companies, also revealed that the United States has approved the opening of a consulate in Hyderabad to encourage business with the State.
Noting that the US was looking at various ways to make business with India easier, Mr Lavin said, the idea was to have an independent economic relation. �We have consistently said that companies have to be serious about doing business with India on a standalone basis. It is not a question of whether to invest in India or Brazil or China, but a necessity. We want to make it easier to do business with India,� Mr Lavin said.
On the Doha round of talks of the World Trade Organisation, Mr Lavin said, �We can expect an outcome if Brussels, New Delhi and we, each show our willingness to take things forward.� He also said that several initiatives have resulted in greater Indo-US business cooperation.
These include the Open Skies Agreement in civil aviation, as a result of which passenger traffic has increased 60 per cent in the last one year, reduction of tariffs on industrial goods, a raise in investment caps in retail by India and efforts to liberalise entry of foreign education institutes. Mr Lavin, however, pointed out that there are a number of challenges facing India-US business ties.

Requirements to change employer when GC is pending:
It is best to not to change to an employer offering you anything less than the wage rate specified in the GC labor certification. On the higher side, it is better not to take up a job that offers more than 4% more salary of that specified in the GC labor certification. It is hard to resist 20-30K higher salary, but one would have to resist the temptation for taking the job offering higher salary. Otherwise, there is a risk of USCIS denying the GC application.
USCIS doesn�t account for dollar appreciation or devaluation. USCIS also doesn�t account for annual inflation when calculating the wage rate. So even if your labor certification was applied in 2003, you still have to continue at the job with the salary specified in the GC labor certification. If GC application takes another 5-7 years, then you have to continue with the salary specified in GC labor certification application.

Finally approved for all family members except my wife (Dependent).
We submitted normal Birth certificate from Municipal Corporation. But got RFE on Birth Document. Any body aware of secondary evidence for birth document. They are asking for oldest health, school, Census or religious record that shows both parent names and DOB.
Anybody experienced this type of RFE before?

I think as a next step I will contact my Congressman after the Feb dates are released and we are still current. Do you know if it makes more sense to approach Congressman or Senator for this ? Also should I approach only 1 rep like 1 Congressman or approach both my district congressman and 2 state senators ?
We are even more screwed because since our dates are current we can not even get 2 Yr EAD or 3 yr H1 extension but you have to renew both annually.
Please share your experiences.

i agree...you bet i would accept substituted labor, heck i would even bid for one if it it was legal to do so. to each his own, i would do anything to get out of the hell hole legally...talk to your lawyer and go for it, it will save you a lots of time and headache. Make sure its all legal and the documentation is in order. there is nothing to hush up, thousands have done this and are doing it. People like me will feel bad and jump up and down, simply because we did not get that chance to do the same..good luck.
