What makes you this guys advocate?
A lot of us can do and will do many things. Your argument does not stand ground. I dont ahave anything against this guy. I have a problem with the system that permits this activity. Because its not fair. By the way I seriously doubt this happens to people in my situation. This is typical of "desi consultant companies". So once again pontiff i dont have a grudge against this guy but the system that allows this to take place.

They do not accept Indian 3 yr bachelors & 2/3years of Masters + 5 years for EB2. This has been discussed lot of times. They expect single 4 year degree.
15yrs of education(India Bachelors) + 5 or more years of education for EB3 is accepted if certain qualifiers are included in the Labor.
Just take care if you are dealing with attorney who saying above thing.
It all depends on what you have in the PERM requirement. If you have like MS, BS or any foreign equivalent as evaluated by reputed firm or equivalent experience then you can get approval

You're absolutely right. Ever since last year's H1-b lottery, I look at this country in a new light. I no longer see this U.S. as the world's greatest country, I suspect this is a civilization in decline. If I were to make a bet where this country will be in 50 years, I would bet it would lose it's position as a superpower and the most successful economy.
This H-1b and GC mess to me is an indicator of how things are run in this country. With all these major problems: immigration, healthcare -- there's just an attempt to sweep problems quietly under the rug or apply band-aid fixes such as a lottery.

Irrespective of the immigration impact and its direct effect on me, I have tried analyzing the situation at the macro level and I end up at the same conclusion.
Health care, immigration, social security insolvency etc. no one cares about anything. Companies want to bring skilled labor in and it is being decided by a lottery!! I mean give me a God damn break. In the supposedly knowledge-driven economy, skilled workers are being selected by a lottery!
Medical emergencies are the leading cause of bankruptcy and there is just talk on the issue, no action.
Farms are shutting down and moving operations to Mexico. So now the oil will come from Middle East, manufactured goods from China and food from Mexico. And people are Ok with that because "companies just need to pay higher wages to *American* workers" So on top of $ 4 /gallon gas, we will be paying $ 8 for tomatoes.
There are not the marks of a prospering or forward-looking nation. May be I am becoming cynical as I grow older and may be things are no better in other countries like Canada, UK etc. But sometimes I feel as if I am watching a bad comedy show in slow motion. I question myself if my son, a US citizen by birth, will end up growing in a 2nd world country.

Collecting contributions and spending them on political influence activities without making sure that all legal requirements are fulfilled is a dangerous endeavour. I hope you have everything set up the right way so you don't run afoul of the law (fixing retrogression is not going to do you any good if you are fighting a federal wire-fraud indictment at the time of your adjustment interview).

Lets take a step back and look at the income of the org till now. As we have displayed on the website, we have collected USD30,000.
Consider that there are 5 board of directors of this org. These guys are all well settled in their jobs and earn a decent living.....but hey here is $6K for each of them now :). Of course they will do a 'wire fraud' for this USD 6k after all this 6K will buy them a new house and a mercedes...right? Who cares about felony, 6K can change anyones life....wouldn't you hadron be willing to spend a year in prison for 6k? Sounds tempting right? Oh wait, but the amount is not really 6K since we have hired QGA. Dang, there goes the dream of owning a beach house with a mercedes!
To think of something like this is not just ludicrous, its downright insulting....instead of encouraging folks who have taken upon themselves to do something about it, you are hell bent on spreading malice and sowing seeds of doubt in everyone's mind! We very well know what we are doing and we are doing so in a 100% legal manner.
Forget about us, do you think a firm as reputed as QGA would want to associate themselves with an org like us if we were not legit? Think again! Some of the folks who had gone to DC (on personal expenses, mind you)to have a preliminary discussion with QGA actually met Mr. Jack Quinn who used to be a legal counsel to Bill Clinton...do you think he has time to meet crooks who don't know a word about law and are doing something illegal? Same with Attorney Matthew Oh. And how about Dr. Richard Florida? What are the odds of him endorsing an organization which is 100% illegal and committing a wire fraud? The answer is very obvious

BTW, can you call and ask if you case is preadjudicated. In our case my #@$@ lawyer refuses call USCIS or allow us to initiate an SR (one of the reasons why we had no idea that we were stuck in namecheck)

The only sliver lining is that ROW's who had visa's available but were stuck due to processing delays will be relieved from the pain.
As per this everyone who got pre-adjudicated would be receiving their GC in FY2010. But, there are people from EB3I with PD as late as 2007 who got RFEs recently and got their cases pre-adjudicated( I am one of them even though my PD is March 2003 and when I called up NSC, they said my case was pre-adjudicated and waiting for a Visa number ).
With EB3I staying at 1 Nov 2001 when the new FY2010 quota starts in October doesnt match to what Ron Gotcher says.

For all Eb3s along with EB2s with PD after April 2005, the movement in the coming visa bulletins wont be much encoraging unless the new Obama government does something significant about employent based category or immigrationvoice does a fruitful lobbying. The doings of something by obama government to employment based category is not in our hands. The only thing we could do is to help IV and help ourrselves by contributing to it to reach its financial target for better lobbying. that's what happened with us as well.. Waiting for 80 days now on AP and already changed the tickets twice..
ramus, i dont think local office will issue AP unless its an emergency. I am saying this bcoz i was in the local office today and they made it clear unless its absolute emergency AP will be issued only by NSC. In case of emergecy you need to show a valid proof that someone in your family is seriously sick.

This is not to oppose your message - I am just trying to figure out where these arguments comes from because I don't think I believe in this whole fraud thing. AC21 is meant for one to change jobs after working for the original sponsoring company for 180 days. Also, there are no clear guidelines stating that one must inform the USCIS - so what will this fraud be based on? How can one be committing fraud if there are no guidelines to tell you what is considered fraudulent? I think one is fraudulant when one actually violates some set rules etc. I don't think the USCIS can have a basis for suspecting someone of fraud when they don't even have a definition of what may constitute fraud in this case because of the lack of guidelines. Plus, I have never, ever heard of anyone be denied or suspected of anything like this during citizenship, I just don't believe this is a factor AT ALL. I see these comments a lot and they just don't make any sense to me. To me, it is like breaking a law that doesn't exist. And you say one may be "suspected", well, suspicion is just that, suspicion. The USCIS needs to show proof that you intended to be fraudulent and for as long as there are no AC21 guidelines that tell you that you must inform the USCIS upon invoking AC21, the USCIS will not and cannot have a case against you.

Based on the "If they return from the USA after having used the visa" exemption, you don't need a transit visa for the USA-Germany-India leg. But for the return you'll either need an AP+transit visa OR a valid USA visa.
This exemption (and regulation) is the same as that for France. And I just traveled to India and back (in Dec2010) through Paris on expired USA visa and therefore know the above to be true (at least for France).

Note: These details may be true. Last month we had heard such information but not in detail and thus had not posted it. We were hoping to get this news within 6-8 weeks (As per oour note on http://immigrationvoice.org/forum/showthread.php?t=14749). There are efforts to make name checks current and that is good news for everyone waiting for several years in the namecheck blackhole. It will also help recent applicants who might be getting into this problem.

My employer is not giving copy of my I140. With out I140 how to port it to an other job/employer etc ?
