    If you recall IV posted news that there will be 3 bills in house regarding backlog. Immigration-law.com didnot even know at that time. I agree that IV didnot post about their movement on bill. IV core team might be busy on lobbying. Just wait and watch.

    Will there be two bills for STEM and allowing people to file I 485 ?

    Yes. I got mine extended in FL with EAD.. but the extension was only for an year eventhough the EAD was for 2-years.

    Please help, in my case my I 140 is approved under EB2 but the old company is split.I have since then joined a new company and have a new H1b but yet to start thr PERM process.I am still in good terms with both partners of the old company.Can I file 485 from the old company and use ac21.

    485 can be filed for future employment. So technically, your old company with one of the partners can file for 485, presuming no other technical flaws with ability to pay and other such stuff. Contact an attorney, but according to me, a strong possibility of filing with old company and then using AC21.

    Hi All,

    I need an advise from IV folks..

    here is my situation..

    I've got my I-485 approved through company A (Future Employment) on 09-2010 (Case details: PD 06 I-140 AD 02 I-485 RD 07-2007 AD 09-2010). I've never worked for the Company A and my GC-sponsoring company is about to close any time. Since 01-2008 I've been working for company B in same/similar field and did not file AC-21. If I want to continue working for company B, do I have to file AC-21? Please let me know if I need to concern about any thing in future.


    Since GC-Sponsoring company is going to close any time... So I cannot return back to that company...


    Please advise me...

    this statement is not true. USCIS does not send I-140 approval to alien as it belongs to employer.
    u will get a copy of the approval notice directly from USCIS though.

    I would suggest get the passport renewed in India using tatkal system. That way you don't have to worry about POE or getting your passport renewed in USA.

    not sure if this topic has been touched before; if we have a i-485 application filed; do we qualify as:
    1) non-permanent resident aliens
    OR
    2) non-resident aliens?

    I suppose you are living in USA.

    On the second option "non-resident alien", if you are residing in USA, then you are not considered as non-resident. So I would eliminate this option.

    On the first option "non-permanent resident alien", if you are residing in USA, I would choose this as the right option. Since holding an H1B means that you are a temporary (non-permanent) resident alien. Holding an EAD does not allow you to stay here permanently. It is only a temporary authorization to allow you to work without H1B. Remember that it requires renewal every year.

    To answer your question, you are a non-permanent resident alien.

    According to my lawyer, you can travel up until the last date on the stamp as long as you have a new 797.

    The sooner you get the stability that your GC brings, the easier it is for you to:
    1. stop wasting money on renewing EADs/APs/ extending your H1B's
    2. buy a house, stop wasting money on rent, build equity!
    3. look for better job opportunities, the sky is the limit if you have the skills!
    4. even within your present job, negotiate a better increment!

    the list is long... (like you didn't know about it:) ) !

    So... invest now in your future and sign up for a monthly contribution!

    You know you will thank yourself you did!
